The T.N. Godavarman Thirumulpad Vs. Union of India case which is popularly known as the Godavarman Case is known as one of the most important judicial interventions in the history of preservation of forests and enforcement of environmental laws in India. This case is significant as it revolutionized the way the interpretation of the Forest (Conservation) Act, 1980 was done by the courts, and laid the foundation for environmental jurisprudence in the country. The case began in the mid 1990s and has had wide-ranging implications on conservation and management of forests, environmental protection, and the role of the courts in enforcement of environmental laws.

Background and Origin of the Godavarman Case
The case was initiated by T.N. Godavarman Thirumulpad, who was a landlord from the Nilgiris district in Tamil Nadu. He filed a petition under Article 32 of the Indian Constitution in the Supreme Court in 1995. T.N. Godavarman’s concern stemmed from large-scale deforestation, illegal logging, and unsustainable forestry practices in his ancestral lands and surrounding forest areas in the Nilgiris. He sought the intervention of the Supreme court to prevent the destruction of forests and ensure effective implementation of the Forest (Conservation) Act, 1980.
This case was originally aimed at addressing the specific issue of degradation of forests in Tamil Nadu, but later on it expanded to cover forest conservation across the entire country. The Supreme Court issued directions to the state government as well as the central government to protect forests nationwide. The active intervention by the Supreme Court transformed the Godavarman case into a watershed case for observation of forest and environmental protection.

Key Issues Involved in Godavarman Case
Different High Courts and Supreme Courts have used the Godavarman case as a benchmark while pronouncing judgment on various other cases. The judgment has addressed multiple environmental issues, ranging from encroachments of forest lands to wildlife conservation, the regulation of mining activities within forest areas. These are some of the important issues involved in Godavarman case:
- Defining Forests: The most important contribution of the Godavarman case was the Supreme Court’s interpretation of the term ‘forest’. The court was of the view that "forest" must be understood in its dictionary sense.
- Illegal Encroachments: The Court directed the state forest departments to identify and remove all types of illegal encroachments in forest areas.
- Industry: The Godavarman case affected wood-based industries. - Mining: Court asked the state forest department to scrutinize different mining activities in the forest areas. The Court even imposed a ban on mining activities in ecologically sensitive regions.
- Wildlife Protection: Court directed the state government to take more stringent actions for wildlife protection.
- Compensatory Afforestation Fund Management and Planning Authority (CAMPA): One of the main outcomes of the Godavarman case was the establishment of CAMPA funds. CAMPA fund is utilized for afforestation and reforestation activities.
