Composition of the High Court

• Each High Court comprises of a Chief Justice and other judges who are appointed by the President .
• The number of judges in the High Courts is not fixed and varies from Court to Court and from State to State.

Qualifications and Tenure of High Court Judges

To qualify for appointment as a Judge of the High Court, a person must:

• Be a citizen of India.
• Have held a judicial office in the territory of India for at least ten years.
• Have been an advocate of one or more High Court for at least ten years.

Key Terms Associated with High Courts in India

Tribunal – A tribunal is a body that acts judicially, irrespective of whether it is termed a tribunal in its title. For instance, a single judge sitting on a Court could be described as ‘their tribunal’ by an appearing advocate.

Permanent Bench – A permanent bench is composed of one or more High Court judges who sit throughout the year at a specific location that is different from the permanent seat of the High Court.

Circuit Bench – A Circuit Bench is established for areas that are remote but do not have sufficient matters to warrant a full-fledged permanent bench. As a result, judges travel to these areas once or twice a year and dispose of all the High Court appeals of that jurisdiction.

Division Bench – In a Division Bench, a case is heard and decided by at least 2 judges.

Full Bench – A Full Bench refers to a court of law consisting of a greater-than-normal number of judges.

Interesting Fact:

Calcutta High Court was established on 1st July 1862. It is one of the three Chartered High Courts in India, along with the High Courts of Bombay and Madras.
